ARTICLE 2 – SUBJECT
The subject of this Agreement is to set out the rights and obligations of the parties regarding the sale and delivery of the products ordered electronically by the BUYER through www.mabayco.com.
ARTICLE 3 – PRODUCTS
The type, brand, model and quantity of the products, the sale price including taxes, delivery charges, payment method and delivery details are shown in the order summary displayed to the BUYER when the order is completed and in the order confirmation sent to the BUYER by email, and form an integral part of this Agreement.
ARTICLE 4 – GENERAL PROVISIONS
- 4.1 – The BUYER confirms having read the preliminary information on the main characteristics of the products, the sale price including taxes, the payment method and delivery, and having given the necessary confirmation electronically.
- 4.2 – The SELLER will deliver the products to the BUYER, or to the person or organisation at the address designated by the BUYER, within the estimated lead time stated on the product page or in the quotation, counting from receipt of the order and payment. For consumer purchases, this period may not exceed the statutory 30 (thirty) days.
- 4.3 – Unless otherwise stated, delivery charges are borne by the BUYER and are shown in the order summary.
- 4.4 – The SELLER cannot be held liable if a product that the BUYER has asked to be delivered to another person or organisation is not accepted by that person or organisation.
- 4.5 – The SELLER is responsible for delivering the products intact, complete, in conformity with the specifications stated in the order and, where applicable, with documents such as the technical data sheet (TDS), safety data sheet (SDS) and certificate of conformity (CoC).
- 4.6 – The BUYER is advised not to accept a package that is visibly damaged on delivery and to have the carrier record the damage in a report; the damage must be notified to the SELLER on the day of delivery.
- 4.7 – Payment of the price is a condition for delivery. If the price is not paid or the payment is cancelled by the bank, the SELLER's obligation to deliver ceases.

- 4.9 – If it becomes clear that the product cannot be delivered due to force majeure or impossibility of performance, the SELLER will notify the BUYER within 3 (three) days of becoming aware of it and refund the amount collected within 14 (fourteen) days. The BUYER may instead ask for delivery to be postponed until the obstacle is removed or for the product to be replaced with an equivalent, if available.
- 4.10 – This Agreement is concluded when the BUYER confirms the order electronically.
- 4.11 – Prices published on the Site are valid until updated; time-limited prices are valid until the end of the stated period. Price changes made after an order is completed do not affect that order.
ARTICLE 5 – RIGHT OF WITHDRAWAL (CONSUMERS)
- A BUYER purchasing as a consumer has the right to withdraw from the contract within 14 (fourteen) days of delivery of the product to them or to a third party they designate, without giving any reason and without paying any penalty.
- Notice of withdrawal must be given within this period in writing to the address in Article 1 or by email to hello@mabayco.com.
- The BUYER shall return the product with its invoice to the SELLER within 10 (ten) days of the notice of withdrawal. The SELLER shall refund all amounts collected within 14 (fourteen) days of receiving the notice, using the original payment method and without any charge to the BUYER.
- Under Article 15 of the Regulation, the right of withdrawal does not apply to products prepared to the BUYER's specifications or specially procured, products that deteriorate rapidly or may pass their expiry date, products whose protective elements such as packaging, tape or seal have been opened after delivery and which are unsuitable for return for health or hygiene reasons, and products that become mixed with other items after delivery.
- Where payment is made by credit card or a similar payment card, the consumer may request cancellation of the payment on the grounds that the card was used without their consent and unlawfully.
