PRELIMINARY INFORMATION FORM

This form is provided to the BUYER before the order is placed, in accordance with Consumer Protection Law No. 6502 and the Distance Contracts Regulation published in Official Gazette No. 29188 of 27 November 2014 (the "Regulation"). Provisions on the right of withdrawal and consumer rights apply only to a BUYER acting as a consumer.

2. MAIN CHARACTERISTICS OF THE PRODUCTS
The name, brand, packaging or variant, quantity and unit price of each ordered product are shown in the order summary at the payment step and in the order confirmation. Technical characteristics are given on the product page and, where available, in the technical data sheet (TDS) and safety data sheet (SDS).
3. PRICE, DELIVERY COST AND PAYMENT
The total price of the products including all taxes, the delivery cost and any other charges are shown in the order summary, in the currency of the order, before the order is confirmed. No charge other than those shown is requested from the BUYER. Payment is made by the method selected at the payment step.
4. DELIVERY
The SELLER delivers the product to the address provided by the BUYER within the lead time stated on the product page, in the quotation or in the order confirmation, counted from the date the order reaches the SELLER. For consumer purchases this period may not exceed 30 (thirty) days. If the SELLER claims that performance has become impossible, the SELLER informs the BUYER within 3 (three) days of becoming aware of this and refunds all amounts collected, including delivery costs, within 14 (fourteen) days of the notice.
Products classified as dangerous goods are shipped in accordance with the applicable transport regulations; the transport method for these products may differ.
5. RIGHT OF WITHDRAWAL (CONSUMERS)
A BUYER acting as a consumer may withdraw from the contract within 14 (fourteen) days without giving any reason and without paying any penalty. The period starts on the day the product is delivered to the BUYER or to a third party designated by the BUYER other than the carrier; for orders delivered in several parts, on the day the last product is delivered. The BUYER may also exercise this right between the conclusion of the contract and delivery.
Notice of withdrawal may be sent within this period by email to hello@mabayco.com, by registered email (KEP) to mabayco@hs01.kep.tr, or in writing to the SELLER's address in Section 1. The BUYER may use the withdrawal form at the end of this document or any other clear statement.
The BUYER returns the product to the SELLER within 10 (ten) days of sending the notice. Returns are made with the carrier designated by the SELLER, and no return shipping cost is charged to the BUYER. The SELLER refunds all amounts collected, including the original delivery cost, within 14 (fourteen) days of receiving the notice, in a single payment, using the same payment instrument and without charging the BUYER any cost.
The BUYER is not liable for changes or deterioration resulting from using the product in accordance with its operation, technical characteristics and instructions for use during the withdrawal period.
For products classified as dangerous goods, please contact the SELLER before returning them so that the return can be shipped in compliance with transport regulations. This does not restrict the right of withdrawal; return arrangements and costs remain the SELLER's responsibility.
6. CASES WHERE THE RIGHT OF WITHDRAWAL DOES NOT APPLY
Under Article 15 of the Regulation, the right of withdrawal cannot be exercised in particular for:
- products prepared in line with the BUYER's requests or personal needs (e.g. custom cutting, filling or repackaging into a non-standard size, custom mixing or tinting);
- products that may deteriorate quickly or pass their expiry date (e.g. frozen premixed sealants that must be kept in cold storage);
- products whose packaging, tape, seal, package or other protective elements have been opened after delivery and whose return is unsuitable for health and hygiene reasons;
- products which, after delivery, are by their nature inseparably mixed with other items.
7. COMMERCIAL PURCHASES
Where the BUYER purchases for commercial or professional purposes, the right of withdrawal and the consumer provisions of Law No. 6502 do not apply; the sale is governed by the Turkish Commercial Code, the Turkish Code of Obligations and the quotation and order terms. Under Article 23 of the Turkish Commercial Code, a defect must be notified to the SELLER within 2 (two) days of delivery if it is apparent, otherwise within 8 (eight) days; defects that cannot be detected by ordinary inspection must be notified immediately upon discovery.
8. DEFECTIVE PRODUCTS
A BUYER acting as a consumer may, in the case of a defective product, exercise the rights under Article 11 of Law No. 6502: withdrawal from the contract, price reduction, free repair or replacement with a non-defective product. Unless a longer period is provided by law, claims relating to defects are subject to a limitation period of 2 (two) years from delivery.
9. COMPLAINTS AND DISPUTES
Complaints may be submitted to the SELLER using the contact details in Section 1. Consumers may submit complaints and objections to the consumer arbitration committee at their place of residence or where the transaction took place, within the monetary limits announced annually by the Ministry of Trade, and to the consumer court for disputes above those limits. Applying to a mediator before filing a lawsuit at the consumer court is a precondition for the lawsuit.
10. FINAL PROVISIONS
This form is an integral part of the Distance Sales Agreement. The SELLER sends this form and the Distance Sales Agreement to the BUYER's email address on a durable medium at the latest before delivery. By ticking the confirmation box at the payment step, the BUYER confirms electronically, before placing the order, that they have read this form and that the order entails an obligation to pay.
